Principally, the user can visit our website www.designplanet.de without providing any personal data. When processing personal data (e.g. name, e-mail address or phone number) of the data subject we always follow the regulations of GDPR and the Federal Data Protection Act. With this data protection statement we want to inform the data subject about nature, scope, and purpose of the collation, processing and use of the personal data. Also we would like to inform the users of our website about their rights with respect to the use of their personal data.

As controller of our website www.designplanet.de we have implemented technical and organizational measures to ensure the highest possible protection of personal data collected on this site. Nevertheless, internet based data transfer might be subject to security issues, so no absolute protection can be guaranteed.

3. Collection of Data

Processing of Personal Data
“Personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Basically, we process personal data of our users only insofar as this is necessary for a functioning website and for our content and services. The processing of personal data of our users takes place only with the consent of the user. An exception applies, if it is not possible to obtain prior consent for factual reasons and data processing is permitted by law. Principally, the user can visit our website www.designplanet.de without providing any personal data.
In no instance collected data will be sold or forwarded to third parties.
Collection and processing of non-personal data (access data / server log files)
If you just visit our website, access data is stored within so-called server log files by the web space provider. We are not able to assign these data to specific persons.
The following information is collected:

  • Websites accessed by the user's system through our website
  • Date and time of the server access
  • Amount of transferred data
  • Information if inquiry was successful
  • Information why an inquiry was unsuccessful
  • Operating system, browser type and browser version
  • Referrer-URL (previously visited website)
  • Host name of the accessing computer (IP address)
The above-mentioned data is collected for statistical evaluation, to run, protect and optimize our website. The anonymous data of log files is stored separately from personal data. Further collection of data is done only on voluntary basis. We use these data to improve our site constantly. The provider reserves the right, to check log files subsequently, if there is tangible evidence and reasonable doubt of unlawful utilization.

4. Cookies

Our website uses cookies. Cookies are text files that are stored on the user's computer system. Cookies enable DESIGN PLANET to recognize the user when visiting his website again. The purpose of recognition is to enhance user-friendliness which wouldn’t be possible without this feature.

Our cookies do not store personal data. Most browsers are configured to accept cookies automatically. But you can change settings to disable acceptance of cookies or to send alerts when cookies are used. Also cookies can be deleted anytime in the browser or other software programs. Most common internet browsers do allow this. However, please be advised that by disabling cookies you may not be able to make full use of all website functions.

5. Deletion and Blocking of Personal Data

We do store personal data of our users only so long as necessary to fulfil the storage purpose and no longer then allowed by GDPR or other applicable German Law.

If the storage purpose no longer applies or the storage terms expire, we delete personal data periodically as required by regulation.

6. Rights of Data Subjects

a) Right of Information

You shall be entitled to request information on whether or not we are processing your personal data. Please contact us directly if you wish to enquire whether or not we are processing your personal data.

b) Right of Access

The right of access is set up in two steps. First the data subject can ask the controller to confirm whether personal data of him are processed (see 6 a – right of information). If no personal data are processed, the data subject shall be informed accordingly. If personal data are processed you can request details about following information from the controller:

  • the purposes of processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipient to whom your personal data have been or will be disclosed
  • the envisaged period for which the personal data will be stored, or, if specific information is not possible, the criteria used to determine that period;
  • the existence of the right to request from the controller rectification or erasure of your personal data or restriction of processing of your personal data or to object to such processing;
  • the right to lodge a complaint with a supervisory authority;
  • any available information as to their source; where the personal data are not collected from the data subject;
  • the existence of automated decision-making, including profiling, referred to in Art. 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
You have the right to request information, if your personal have been transferred to third countries or international organisations. In this connection, you can request the appropriate guarantees in accordance with. Art. 46 GDPR in connection with the transfer.
If you wish to exercise your right of access, you may address your request to the controller.

c) Right of Rectification

You have the right to obtain the rectification and/or completion of inaccurate or incomplete personal data concerning you. The controller has to make the rectification without undue delay.

d) Right to Erase (right to be forgotten)

You have the right to obtain from the controller the erasure of personal data concerning you without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

  • Your personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • You withdraw consent on which the processing is based according to Art. 6(1) (a) GDPR, or Art. 9(2) (a) GDPR, and where there is no other legal ground for the processing;
  • You object to the processing pursuant to Art. 21(1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21(2) GDPR;
  • Your personal data have been unlawfully processed.
  • Your personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject;
  • Your personal data have been collected in relation to the offer of information society services referred to in Art. 8(1) GDPR.
If one of the above-mentioned grounds applies the data subject may request the deletion of the data stored at DESIGN PLANET. You may address your request to the controller.

e) Right to Restriction of Processing

Following Art. 18 GDPR you have the right to obtain from the controller restriction of processing of personal data concerning you under the following conditions:

  • if you contest accuracy of the personal data, for a period enabling the controller to verify the accuracy of the personal data;
  • if processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
  • if the controller no longer needs the personal data for the purposes of the processing, but you require them for the establishment, exercise or defense of legal claims;
  • if you have objected to processing pursuant to Art. 21(1) GDPR pending the verification whether the legitimate grounds of the controller override yours. Where processing of your personal data has been restricted, such personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.
If you have obtained restriction of processing pursuant to the above-mentioned conditions, you will be informed by the controller before the restriction of processing is lifted.

f) Right to Data Portability

Following Art. 20 GDPR you have the right to receive the personal data concerning you, which you have provided to a controller, in a structured, commonly used and machine-readable format.
You also have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where the processing is based on consent pursuant to Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR or on a contract pursuant to Art. 6(1) (b) GDPR and the processing is carried out by automated means. That right to data portability does not apply to processing necessary for the performance of a task carried out in the public interest.
In exercising these rights, you have the right to have the personal data transmitted directly from one controller to another, where technically feasible. Rights and freedoms of others shall not be affected by that.

If you wish to exercise your right of data portability, you may address your request to the controller.

g) Right to Object

You shall have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions.
The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.
Where personal data are processed for the purposes of direct marketing, you have the right to object to such processing, including profiling to the extent that it is related to such direct marketing. Where you object to the processing of your personal data for direct marketing purposes, your personal data shall not be processed for these particular purposes.
Where personal data are processed for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) GDPR, you, on grounds relating to your particular situation, shall have the right to object to processing of your personal data, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

h) Automated Individual Decision-Making, Including Profiling

The use of the comfortable route planer is only possible with involvement of Google Maps and the respective data processing. Our legitimate interest for processing personal data is based on this purpose.
  • Duration of Storage:
    We do not store any data provided by the user on the route planer. Concerning the erasure of data by Google the user should consult Google’s above-mentioned privacy policy.

9. Enforceability

This privacy policy shall be considered as part of the internet offer, from where you have been linked to this page. Should parts or individual formulations of this privacy policy not, no longer or not fully comply with the current law, all other sections of the document remain unaffected in respect of contents and validity.
